BioHabit Terms of Use
1. Who and what
These terms apply between you and Simone Grootes, trading as BIOHABIT, Sluterstraat 22, 6661 GH Elst, the Netherlands, Chamber of Commerce no. 99195690 for use of the BioHabit app. BioHabit helps you build a daily rhythm with small actions. It is an app for general wellbeing and not a medical service; read the Health disclaimer, which is part of these terms.
2. Use
You use the app for yourself. You keep your sign-in details private and report misuse. You do not use the app to harm others, copy the app or overload our systems. If you are under 16, use the app with a parent's or guardian's permission.
3. Guest and account
Without an account your data stays on your phone; we are not responsible for it if you delete the app. With an account we keep your rhythm as described in the Privacy Policy. You can delete your account at any time in Profile.
4. Content
The stacks, texts and design belong to BioHabit. You may use them within the app, not copy or distribute them.
5. Your responsibility
You decide whether and how to perform an action. Follow the warnings shown with actions and check with a healthcare professional if in doubt.
6. Availability and changes
We do our best to keep the app available but cannot rule out outages. We may change the app and these terms; for a material change we will inform you in the app. If you disagree with a change, you can stop using the app and delete your account. BioHabit is currently free to use. If we add paid features later, you will see the price beforehand and decide for yourself whether to pay.
7. Liability
We work carefully. To the extent the law allows, we are not liable for damage that arises because you perform an action that does not suit your situation. This limitation does not apply to intent or deliberate recklessness on our part and leaves your mandatory consumer rights intact.
8. Apple
The app is delivered through the App Store. Apple is not a party to these terms and has no maintenance or support obligation.
9. Law
Dutch law applies. If you live in another EU country, you keep the protection of that country's mandatory law. We will first try to resolve disputes together; after that, the competent court in the Netherlands decides.
